Reliance Infrastructure (R-Infra ) on Monday informed the Bombay High Court that it could not strike a deal to buy power from Tata Power Company (TPC) April last year as the Tata company pulled out of negotiations.
In the affidavit filed on Monday, R-Infra has contended that TPC backed out of the negotiations after the Supreme Court held that generating companies were not obliged to supply power to any firm in the absence of a supply agreement.

R-Infra’s submission follows the petition filed by TPC last month alleging that the former was not ready to sign an agreement. In the absence of an agreement, the Maharashtra government should not compel the Tata company to sell power to R-Infra , TPC had submitted to the court.
TPC had moved the Bombay High Court against the May 7 order of the Maharashtra government which asked the company to supply 360 MW power to R-Infra . It made R-Infra a party to the case. R-Infra said in its affidavit that it would buy power from other suppliers but that would start only in April next year. R-Infra customers will suffer if the company does not get power from TPC, it added in the affidavit.
