CERC proposes to curb power supply to defaulters




The Central Electricity Regulatory Commission (CERC) has proposed norms for the reduction of power supplies to defaulting entities that fail to clear their outstanding dues for the power drawn from a generating station or the use of transmission assets of a licensee, on time. As per recent draft regulations brought out by CERC, the generating companies or the transmission licensees will be authorized to reduce the draw-schedule for such defaulters through a revised power draw plan, to be prepared by the concerned Regional Load Despatch Centre (RLDC) or the State Load Despatch Centre (SLDC), under the jurisdiction of which the defaulting entity falls


Further, the generating company will be entitled to sell the surplus power left due to the curb in power supply to any entity, including any of the existing beneficiaries. The revenue generated on account of sale of this power will either be adjusted against the outstanding dues of the defaulting entity or passed on to the transmission utility to the extent of outstanding dues. The remainder will be remitted to the defaulting entity, after deduction of energy charges, trading margin and other incidental expenses borne by the power generating company.


Pertinently, these norms will be applicable to the power generating stations, transmission systems and their beneficiaries where the power generator or the transmission licensee and the power off-takers have executed agreements, incorporating a specific provision for power supply regulation in case of non-payment of outstanding dues or non-maintenance of letter of credit (LoC). The apex regulator intends to finalize these draft regulations after gauging public response to the same. Comments can be submitted by June 25, 2010.
